Cooperação jurídica internacional à luz do CPC/15

Abstract

The purpose of this article is to address International Legal Cooperation through the 2015  Code of Civel Procedure, highlighting the importance of the topic today, with the emphasis on  territorial competence. The method to be used will be the deductive one, through bibliographic  searches, public documents such as magazines, newspapers, monographs, scientific articles,  judgments and guiding principles of the Brazilian legal system. It will be briefly presented the  indispensable concepts regarding international cooperation and how it develops in the legal field  through the modalities provided for in CPC/15, namely, the letter rogatory, the homologation of  foreign judgment and direct assistance. The concept of territorial jurisdiction, the limits of national  jurisdiction, the choice of forum and the analysis of real cases in which national jurisdiction and the  forum election clause, involving Brazil and South Korea.
