This scientific article deals with working relationships in religious institutions. Specifically, the work performed by ministers of faith in religious institutions and what is the labor relationship between religious and their institutions. It brings the following problem: what is the working relationship exercised by ministers of worship within religious institutions, what is their regulation and, what is the jurisprudential understanding on the subject? After all, the judiciary cannot refrain from judging an action and Brazil is a Secular State, thus having the separation between state and church. Because separation occurs, the State must interfere as little as possible in the relations of religious organizations and vice versa. This article aims to understand the relationship exercised between ministers of faith and religious entities, whether there is the characterization of employment in these relationships and what the understanding of the Judiciary on the matter is. The methodology used is the hypothetical-deductive and the analysis techniques used are: bibliographical research, legislation and jurisprudence. The understanding about the bond of religious organizations and their minister is not peaceful, the majority perception is that there is no employment relationship, but there is the exception of when the distortion of religious purposes occurs, and it is necessary to be present the requirements for the existence of employment relationship.
