Abstract

The homestad (provided in Law nº 8.009/90) is an unquestionable means of protecting  the minimum assets, the existential minimum and the right to housing. However, the role of the  institute, as well as Law as a science, has undergone numerous changes over the centuries,  especially in terms of its concept and characteristics. The function of this article is to analyze  whether the homestead, within the legal system, may have a value limitation, thus allowing the  expropriation of a surplus portion, if it is characterized as being expansive.
